Snake is a playstation character but he was in the Super Smash Bros Brawl so his basicly both ?

No. Snake was introduced into one game in a team effort to make an epic game. Solid Snake, Naked Snake, Liquid Snake, Solidues Snake, and Grey Fox are all still copyright of Sony. Solid Snake and Grey Fox are Sony characters that appeared in a Nintendo game.

But that's wrong, loads of Metal Gear games have been on nintendo consoles. He's third party though, not a nintendo character.
